Hereinafter: we, us, or Certilogies. The customer is referred to as “you.”
2. TO WHICH THESE TERMS AND CONDITIONS APPLY
These terms and conditions apply to every quote, order, and agreement between Certigroup BV and a customer, regardless of whether the order is placed via our website, an online order form, our portal, by email, by phone, or in person.
By placing an order, you accept these terms and conditions. Deviations are valid only if we have confirmed them in writing. The customer’s own terms and conditions do not apply, even if they are stated on an order form, email, or invoice from the customer.
Where the term “consumer” appears below, we mean a natural person acting for purposes outside of their commercial, business, craft, or professional activities. Article 10 applies exclusively to consumers.
3. WHAT WE OFFER
Certilogies specializes in fire safety for tourist accommodations and residential properties. Our services consist of three types of offerings, which are often combined in a single order:
- On-site services—inspection visits, the inspection and testing of fire extinguishers, maintaining a fire safety log, and measuring a property.
- Delivery and installation of equipment—smoke detectors, fire extinguishers, evacuation plans, and related equipment, delivered and installed during the visit.
- Facilitation — applying for, scheduling, and following up on inspections conducted by a certified organization or a third party, and collecting and storing the corresponding certificates.
In our facilitation role, we act as an intermediary. The inspection itself and the resulting certificate are the responsibility of that organization. We ensure that the request is submitted correctly, that the schedule is properly managed, and that the results are communicated to you.
We carry out what has been ordered. We are not responsible for determining all legal obligations applicable to your property, unless that is explicitly the subject of a requested consultation visit. The operator or owner remains responsible for ensuring that their property complies with applicable regulations.
4. YOUR ORDER
The agreement is concluded the moment you confirm an order: by accepting a quote, by placing an order through our portal, or by clicking the confirmation button on an order page. On our online order pages, that button explicitly states that you are placing an order with a payment obligation.
You will then receive a confirmation via email detailing what you ordered and at what price, along with an invoice. If anything is incorrect, please let us know within seven days.
We reserve the right to refuse or limit an order if the property is located outside our service area, if previous invoices remain unpaid, or if the requested service is technically unfeasible. We will notify you of this and refund any amount already received in full.
5. PRICES AND VAT
All prices are listed in euros. On our order pages, each amount is shown both as the price excluding VAT and as the price including VAT. In quotes and on invoices, amounts are listed excluding VAT, with the VAT rate shown separately.
The applicable price is the price listed on the order form or in the quote at the time of your order. Prices on the website or in prior communications are subject to change as long as no order has been placed.
Travel costs within our service area are included in the price, unless otherwise stated. Parking fees that we actually incur on-site will be passed on to you.
Reduced VAT Rate
A reduced VAT rate may apply to work performed on a residential property. In the absence of a written objection within one month of receiving the invoice, you are deemed to acknowledge that:
- the work is being performed on a residence that was first occupied in a calendar year at least ten years prior to the date of the first invoice relating to that work;
- after the work is completed, the residence will be used exclusively or primarily as a private residence;
- the work is provided to and invoiced by an end consumer.
If at least one of these conditions is not met, you must contest the application of the reduced rate in writing within one month. We will then issue a corrected invoice or a debit memo.
6. PAYMENT BEFORE SCHEDULING
We will not schedule a visit until we have received your payment. As long as the amount has not been credited to our account, you will not receive a date, and we will not reserve a slot for you.
We operate on fixed routes by region. Scheduling a single visit requires setting aside half a day of driving time; that is why payment is due in advance. This payment is not a deposit but rather payment for your order.
As soon as we receive your payment, we will include your property in the next scheduled route in your region and propose a date to you. If payment is not received, your order will remain open without a date; we will remind you and cancel it if payment has not been made after a reasonable period of time.
Any additional work we perform, items we deliver, or inspections we arrange during the visit will be billed afterward. These invoices are due within fourteen days of the invoice date.
7. WHEN WE COME
We schedule a day, not a specific hour. A visit will take place at some point during the agreed-upon day. We cannot guarantee a specific time: the order of events during the day depends on traffic and what we encounter along the way.
After we propose a date, we’ll ask you to confirm it. If you do not confirm and we do not receive a response even after a reminder, we reserve the right to cancel the visit, and your order will be moved to the next round.
We prefer to schedule within a few weeks of your payment, but the wait time depends on the schedule in your area. If we are unable to schedule a visit within three months of your order, we will let you know, and you may cancel free of charge with a full refund.
8. ACCESS TO THE PREMISES
You must ensure that we can gain entry on the agreed-upon day. This can be arranged by having you present, by leaving a key at your rental agency, or by using a key locker for which you provide us with the code.
If we are unable to gain entry, the visit will be considered to have taken place and the fee remains due. We will schedule a new date with you at the then-current service call fee.
If we work through your rental agency, your property manager, or another administrator, you agree that we may make arrangements with that party regarding the date of the visit and access, and that we will keep them informed of the results.
You are responsible for ensuring that the appliances and systems to be inspected are accessible. If we need to move furniture or open a drop ceiling, we will not do so.
9. CANCELLATION AND RESCHEDULING
Canceling
an Order
If you cancel within forty-eight hours of placing your order, there is no charge and we will refund the full amount.
After that, we will deduct an administrative fee of €25 (excl. VAT) per item ordered. This is because preparations have already begun within those forty-eight hours: your file is created, your property is included in a delivery route, and we’ve exchanged emails and phone calls with you and your rental agency regarding the date and the key. That work has been done and cannot be undone. We’ll refund the balance within fourteen days using the same payment method.
If we cancel an order ourselves without being able to offer you an alternative, we will refund the full amount and pay you the same fee of €25 per item ordered. Whatever we charge if you cancel, we will pay if we cancel.
If you are a consumer, please read Article 10 first. Your right of withdrawal takes precedence over this article.
Rescheduling
an Agreed Date
A scheduled date can be rescheduled free of charge up to six business days before the service is to be performed. If the schedule was created later, the shorter deadline stated in the confirmation email applies.
After that, our route is fixed and other customers in the same area are already scheduled; rescheduling would then affect not just one appointment but an entire day. If you cancel or reschedule after that deadline, we may charge the call-out fee and any costs already incurred.
We may reschedule an appointment ourselves in the event of illness, vehicle breakdown, extreme weather conditions, or force majeure. We will notify you as soon as possible and propose a new date. This does not entitle you to compensation. If you cannot accept the new date and we cannot find an alternative, we will refund the portion of the service not performed.
10. RIGHT OF WITHDRAWAL FOR CONSUMERS
If you place an order as a consumer via our website, by email, or by phone, you have the right to withdraw from the contract within fourteen calendar days of its conclusion, without providing a reason.
You may exercise this right by notifying us unequivocally, for example by email to info@certilogies.be. We will confirm receipt and issue a refund within fourteen days using the same payment method.
This right is mandatory. If you have not asked us to begin services within those fourteen days, you will receive a full refund—the administrative fee specified in Article 9 will not be deducted.
A visit within those fourteen days
Our service rounds do not always fall within that timeframe. If your visit falls within that period, it can only proceed if you explicitly request it. When placing your order, please check the following box separately:
“I expressly request that Certilogies perform the ordered service within the fourteen-day withdrawal period, including its preparation and planning. I acknowledge that I lose my right of withdrawal as soon as the service has been fully performed, and that if I withdraw before that time, I will pay for what has already been delivered.”
If you requested this and then cancel after we have begun but before the service is completed, you will pay an amount proportional to what has already been delivered. For preparation and planning, this is the administrative fee specified in Article 9; if the site visit has already taken place, the full price is due.
If the service was fully performed within those fourteen days at your express request, your right of withdrawal is exhausted.
Cases in Which the Right of Withdrawal Does Not Apply
- Goods manufactured according to your specifications. An evacuation plan is drawn up for a specific building and cannot be used anywhere else; once we have begun drafting it, it can no longer be canceled.
- To a fully performed service whose performance began within the time limit at your express request, as described above.
- If you are ordering as a business—a rental agency, a property manager, or a corporation—there is no right of withdrawal. Article 9 applies in full in such cases.
11. WHAT WE DETERMINE
ON SITE
We check what was ordered and note any issues. If additional work is required—such as an expired smoke detector, a fire extinguisher that fails inspection, or an evacuation plan that is no longer up to date—we will carry it out only with your express consent and at the rates communicated to you in advance.
You can give this consent in advance, for example, by confirming when you place your order that we may immediately rectify any identified deficiencies. In that case, you will be billed afterward for what was actually performed, delivered, or inspected. The rates applicable at that time will be listed on the order page.
Without your consent, we will not perform any additional work. We will then report what we have identified, and the consequences are your responsibility.
A rejected device that we take away for recycling at your request will not be reimbursed.
12. DELIVERED MATERIALS
Materials delivered and installed remain our property until they are paid for in full. However, the risk transfers to you at the time of installation.
Materials are covered by the statutory warranty. For consumers, this is two years from the date of delivery; you must report any defects within two months of discovering them. The warranty does not cover normal wear and tear, damage caused by misuse or third-party interference, or the replacement of a battery or fire extinguisher that has reached the end of its service life.
A smoke detector, fire extinguisher, or evacuation plan must be inspected or replaced periodically. We will notify you when an expiration date is approaching, but it remains your responsibility to monitor those expiration dates.
13. INSPECTIONS, CERTIFICATES, AND LIABILITY
We perform our work in accordance with best practices and the standards in effect at that time. An inspection or assessment reflects the condition at the time of the visit and does not indicate the condition for the period thereafter.
We are not liable for:
- defects that were not visible or detectable during a normal, non-destructive inspection;
- changes made to the premises or installations after our visit;
- the consequences of incorrect or incomplete information you provided to us;
- failure to obtain a certificate when the cause lies outside the scope of the commissioned work;
- the decision, timeframe, or result of an inspection conducted by a certified body;
- indirect damages, lost rental income, or the loss of a permit or certification.
In any case, our liability is limited to the amount of the invoice for the assignment in question and to the amount paid out by our professional liability insurance in that case. This limitation does not apply in cases of willful misconduct, gross negligence, or personal injury.
14. COMPLAINTS
Complaints regarding a completed assignment must be submitted in writing to info@certilogies.be within eight days of completion, stating the order number. Complaints regarding an invoice must be submitted within eight days of the invoice date; after that, the invoice is deemed accepted. For disputes regarding the reduced VAT rate, the one-month period specified in Article 5 applies.
A complaint does not suspend the payment obligation for the undisputed portion.
If you are a consumer and we are unable to reach a mutual agreement, you may contact the Consumer Ombudsman Service free of charge at Koning Albert II-laan 8, Box 1, 1000 Brussels — www.consumentenombudsdienst.be — or via the European ODR platform at ec.europa.eu/consumers/odr.
15. LATE PAYMENT
If an invoice remains unpaid on the due date, the following steps will be taken.
- A first, free reminder after the payment deadline has passed.
- A second reminder, at the earliest fourteen calendar days later, with a surcharge according to the rates below.
- A third reminder by certified mail, with a surcharge covering the actual costs thereof.
- Thereafter, the matter will be referred to a bailiff for collection.
Outstanding balanceFlat-rate fee
up to and including €150€20
€150.01 to €500€30 + 10% on the portion above €150
Above €500: €65 + 5% on the amount exceeding €500, up to a maximum of €2,000
In addition, late payment interest is automatically due at the statutory interest rate, calculated from the calendar day following the second reminder.
In the event of continued non-payment, we may suspend the further execution of ongoing assignments and may delay the release of certificates and documents until payment is made.
If you are not a consumer, a liquidated damages clause of 10% of the principal amount is due by operation of law and without notice of default, with a minimum of €75, along with the late-payment interest specified in the Act of August 2, 2002, concerning late payment in commercial transactions.
16. PERSONAL DATA
We process your data to fulfill the orders you have placed, to contact you regarding appointments and certificates, and to comply with our legal and accounting obligations. Our privacy statement explains what data we store, for how long, and what rights you have.
If you work through a rental agency or a property manager, we will share with that party the information necessary to schedule the visit and report the results.
17. GOVERNING LAW AND JURISDICTION
Every agreement is governed by Belgian law.
The courts of the judicial district of West Flanders, Bruges division, have jurisdiction over all disputes. If you are a consumer, the statutory rules regarding jurisdiction apply, and you may also bring the dispute before the court of your place of residence.
If any provision of these terms and conditions is void or unenforceable, the remaining provisions shall remain in full force and effect, and the void provision shall be replaced by a valid provision that most closely approximates its intent.
